As an initiative to eliminate all types of violence against women and children in Bangladesh and to ensure equal rights for them, Bangladesh has passed the Domestic Violence (Prevention and Protection) Act, 2010 with a view to prevention of domestic violence, protection of women and children from domestic violence and for, matters connected therewith or incidental thereto. By this act, physical abuse, psychological abuse, sexual abuse or economic abuse against a woman or a child of a family by any other person of that family with whom victim is, or has been, in family relationship, has been included as domestic violence. Before the enactment of this act, such types of abuses were unrelieved and most of the victim women or children didn’t get proper legal response through judicial proceeding. This act provides for an exemplary safety net for women and harsh punishment for perpetrators. Punishments for acts of domestic violence are guided by the country’s Penal Code of 1860, which, although ancient, is still current law. Factually, Bangladesh is one of the very few countries in the world with a Muslim majority that considers domestic violence a crime (in most cases) and does not offer leniency for honor killings or impunity for rapes that result in marriages between the victim and perpetrator.
Dowry is one of the weapons used against married women to conduct violence against them in Bangladesh and as an attempt to reduce and prevent and protect such victim, Bangladesh has enacted the Dowry Prohibition Act of 1980.
We understand the hard time of our clients who are victim of such violence and when we deal with such complex and hard realities, our dedicated team of lawyers are here to guide you through these difficult times, offering compassionate and expert legal assistance. What is the Best Way to Settle a Family Dispute?
Legal Opinion:
This is the least invasive way to mitigate a dispute. The parties come together and talk with our expert lawyer and thereafter they provide the parties the possible legal solution of the dispute and if the parties ask for written legal opinion, we also provide accordingly.
Mediation or arbitration: A mediator is a neutral person with the skills to help manage and facilitate discussions. Arbitration is more formal and is a substitute for the court system. An arbitrator acts like a judge, and his decision about your dispute will binding. Cases relating to divorce, maintenance, dower and restitution of conjugal right etc shall be referred at the mediation proceeding before starting trial at the Court. Our experienced team can help support and represent you through such a process.
Going to Court:
Sometimes going to court can be the only option to settle a dispute. Lawyers at Jahangir and Jurists can help make this process as pain-free as possible.
